2. PERSONAL DATA PROCESSED BY MEDSIR
Personal data is any information about an identified or identifiable natural person (the “Interested Party” or “Data Subject”). The personal data that MEDSIR processes come from the information that as a user (“User”) you provide us with when filling in the forms that you will find on the web (“Website”), when browsing it or when sending your queries or information requests.
In each form, the contact information that is necessary to attend your query or request will be indicated by means of an asterisk. The data that is not marked as mandatory through an asterisk will be completely optional. MEDSIR will only collect the necessary data for each purpose. If you do not provide the mandatory information, MEDSIR may not be able to respond your query or request or process your data.
It is your responsibility to provide truthful data and keep it updated, so MEDSIR reserves the right to exclude from the services Users who provide false or incorrect data or data without the proper authorization of the Interested Party, without prejudice to MEDSIR's right to bring any legal action.
3. PURPOSE, LEGITIMACY OF THE PROCESSING, AND TERM OF CONSERVATION OF THE DATA.
3.1. Purpose
The personal data and information you provide us with by completing any of the electronic forms available on this Website will be processed for the following purposes, depending on the section through which the data is provided:
A. Subscription to the newsletter. If you want to receive in your email address provided in the form a newsletter about MEDSIR, own events, or those of third parties, MEDSIR will use your contact information to send these communications.
B. Contact. If you contact us through our channels enabled in this regard, by email or any means that we make available to you, MEDSIR will use the contact information and details to adequately address your queries or requests, which includes the possibility to contact you through different means and the referral of your communications to the corresponding managers so that they can respond to you.
C. Management of participation in selection processes. If you contact MEDSIR through any of the forms enabled for selection processes, MEDSIR will use your contact information and details to manage your participation in the specific selection process for which your provided us with your data, as well as, where appropriate, for the management of your participation in future MEDSIR selection processes that fit your professional profile, if you have consented this.
D. Donation management. Management of donations enabled through the Website in relation to clinical studies.
E. Website Navigation. Using cookies and other technologies, MEDSIR will be able to measure and analyze browsing traffic, the usability and experience of Users on the Website in a statistical manner. The use of cookies depends on the settings you make both in the cookie banner and through your browser.
F. Events. Process and manage your registration and attendance at an event organized by MEDSIR.
G. Image. To process, capture, or disseminate your image or voice, for internal and external communication, promotion, and advertizing purposes.
3.2. Legitimation of the treatment
MEDSIR may carry out the treatments for the purposes described above under the following bases of legitimacy:
a) For the sending of commercial communications or news and information of interest when you subscribe to the newsletter: the consent of the interested party.
b) For contact with MEDSIR: the consent you provide through registration in the corresponding forms or, in some cases, the execution of pre-contractual measures if these are necessary to attend to the query.
c) For the management of your participation in selection processes: the execution of necessary pre-contractual measures, where appropriate, to be able to process your subsequent hiring in MEDSIR. The conservation of your data for your participation in future MEDSIR selection processes that fit your professional profile is based on the consent eventually given.
d) For the management of the donation made by the User in relation to clinical studies: the unequivocal consent of the interested party.
e) In relation to Web navigation: the consent you give when you accept the installation of cookies, which you can revoke or configure at any time through the configuration panel. You can find more information about the use of cookies in the Cookie Policy.
f) For the management of the registration and attendance at an event: the consent of the interested party.
g) For the image use: the consent of the interested party.
If MEDSIR processes your personal data for a purpose other than the ones established in this document, MEDSIR would inform you beforehand, provide you with any additional relevant information in accordance with applicable law, and request your consent if necessary to justify the treatment.
You may revoke your consent at any time. You may also object to continue receiving commercial communications in the manner indicated in the footer of each communication.
3.3. Period of conservation of your personal data
Your personal data will be kept, depending on the purpose for which they were provided, for the periods indicated below:
a) Sending newsletters or commercial communications: until the registered User express their wish to stop being part of the MEDSIR database, or up to a maximum of two years.
b) Contact with Users in response to a request: for the time strictly necessary to attend to your request.
c) Management of your CV in the participation in the selection processes:
i. For the duration of the relevant selection process if it is not finally selected. In case of being selected and accepting the job offer, the term of conservation of your data will be the one applicable to MEDSIR employees.
ii. If you have given your consent for the processing of your data regarding your participation in future MEDSIR selection processes that fit your professional profile: for a maximum period of two years from the date on which you provided them, if you have not been selected in any process, considering that after this period the information on your CV will be outdated. If you are selected and accepts the job offer, the term of conservation of your data will be the one applicable to MEDSIR employees.
d) Management of the donation made by the User in relation to clinical studies: during the period strictly necessary to manage the study and be able to prove the origin of the funds collected.
e) Web browsing data: until you revoke your consent and for a maximum period of one year. In any case, the information on web traffic is deleted periodically, so MEDSIR only keeps statistical data.
f) Events: during the period strictly necessary to manage and celebrate the event.
g) Image: during the period strictly necessary to carry out the processing of the treatment.
Outside the periods indicated above, we will keep your personal data during the limitation period to comply with or exercise our legal obligations or rights (for example, to file or oppose a claim). Likewise, the provisions of the corporate rules regarding the periods of filing and conservation of documentation will apply.
4. RECIPIENTS OF PERSONAL DATA: ASSIGNEES AND DATA PROCESSORS
In certain cases, we may give access to your personal data to third parties (processors) who provide services to us such as communication, marketing, digital media, and social media agencies, which help us to carry out our services efficiently and within the legal framework. Likewise, we can transfer the data to companies in our group for internal management purposes, such as, for example, the management of selection processes.
The processing of personal data by these data processors, with whom a contract has been concluded under article 28 of the GDPR, can be carried out both inside and outside the territory of the European Union. If data transfers are made outside the European Economic Area, these will be made (i) to countries with an adequate level of protection declared by the European Commission (ii) based on the provision of adequate guarantees (standard contractual clauses or binding corporate regulations), or (iii) by virtue of the authorization of the competent control authority or other cases provided for in the regulations.

Outside of the above assumptions, your personal data will not be communicated to third parties, except to comply with a legal obligation.
5. REGISTRATION AND MONITORING OF CORPORATE ACCOUNTS OF SOCIAL WEB NETWORKS
In the case of the profiles that MEDSIR maintains in the different social networks linked from the Web, for example, through plug-ins or third-party applications, your data may be processed under other privacy policies of the owners of said social networks.
The use of such connectors is voluntary. If you choose to use them, you will be authorizing the communication of your personal data (IP address, browsing data) to the aforementioned social networks and MEDSIR will not be responsible for their subsequent processing of your data. We recommend that you visit the terms and conditions of use of said platforms prior to your interaction on social networks with MEDSIR profiles.
The profiles on the social networks linked from this Website have been created so that you can better understand MEDSIR's activity and offer different communication channels aimed at people interested in our entity and the services offered.
6. RIGHTS OF THE INTERESTED PARTIES
You have the right to obtain confirmation as to whether MEDSIR is processing your personal data. You also have the right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its erasure when, among other reasons, said data is no longer necessary for the purposes for which it was collected.
In certain circumstances, you may: (i) request the restriction of the processing of your personal data, in which case we will only keep them for eventual claims; (ii) for reasons related to your particular situation, you may oppose the processing of your personal data, in which case MEDSIR will stop processing them except for compelling legitimate reasons, or for filing or opposing a claim; and, if you have given your consent for a specific purpose, (iii) your consent may be withdrawn at any time, without affecting the legitimacy of the treatment based on the consent prior to said withdrawal.
You also have the right to receive, in a structured, commonly used and machine-readable format, the personal data concerning you that you have provided to MEDSIR, and to transmit such data to another controller without hindrance from MEDSIR. In this sense, you can request MEDSIR to transmit your personal data directly, if technically feasible, to the new person in charge, as indicated in your communication.
You can exercise your rights by sending a digitally signed request (electronic ID or other recognized certificate) to MEDSIR via email to dpo@medsir.org, or by written communication addressed to Medica Scientia Innovation Research, SL, with the address for these purposes at 128 Pere IV St., 3rd Floor, 08005 Barcelona (Spain), with subject or reference "GDPR".
The content of the request must include: your full name; a photocopy of your national identity document, passport, or other valid identification documents, and, if necessary, of the person who represents you, as well as the document or electronic instrument that proves such representation; detail of the request made, address for notifications, date, and signature of the applicant; and supporting documents of the request made, if applicable. You can find additional information about your rights at the Spanish Data Protection Agency.
If you consider that the processing of personal data that concerns you violates the applicable legislation or you are simply not satisfied with the exercise of your rights, you can file a claim with the Spanish Data Protection Agency, by any of the following means: (i) calling +34 901 100 099, or +34 912 663 517; (ii) by electronic means, visiting the website of the Spanish Data Protection Agency (www.aepd.es); or (iii) personally, at Calle Jorge Juan, 6, 28001 Madrid.

2. DATOS PERSONALES QUE MEDSIR TRATA
Un dato personal es toda información sobre una persona física identificada o identificable (el “Interesado” o “Titular de los Datos”). Los datos personales que MEDSIR trata proceden de la información que como usuario (“Usuario”) nos facilite al rellenar los formularios que encontrará en la web (“Web” o “Sitio Web”), al navegar por ella o al mandar sus consultas o peticiones de información.
En cada formulario se indicarán los datos de contacto que sean necesarios obligatoriamente para poder atender su consulta o petición mediante un asterisco. Los datos que no sean marcados como obligatorios a través de un asterisco serán de carácter completamente opcional. MEDSIR solo recabará los datos necesarios para cada finalidad. Se ha de tener en cuenta que, si no facilita la información obligatoria, es posible que MEDSIR no pueda atender su consulta o petición o gestionar el tratamiento.
Es su responsabilidad facilitar datos veraces y mantenerlos actualizados, por lo que MEDSIR se reserva el derecho de excluir de los servicios a los Usuarios que faciliten datos falsos, incorrectos o sin la debida autorización del Interesado, sin perjuicio del derecho de MEDSIR a ejercer cuantas acciones legales correspondan.
3. FINALIDAD, LEGITIMACIÓN DEL TRATAMIENTO Y PLAZO DE CONSERVACIÓN DE LOS DATOS.
3.1. Finalidad
Los datos personales y la información que nos facilite a través de la cumplimentación de cualquiera de los formularios electrónicos disponibles en esta Web serán tratados con las siguientes finalidades según el apartado a través del cual se faciliten los datos:
A. Suscripción al boletín de noticias. En el caso de que quiera recibir noticias o información de interés sobre MEDSIR, eventos propios o de terceros en los que participe a través del correo electrónico facilitado en el formulario, MEDSIR utilizará sus datos de contacto para poder gestionar el envío de estas comunicaciones.
B. Contacto. Si contacta con nosotros a través de nuestros canales habilitados a este respecto, por correo electrónico o cualquier vía que pongamos a su disposición, MEDSIR utilizará los datos de contacto y los detalles que nos facilite para atender adecuadamente sus consultas o solicitudes, lo que incluye la posibilidad de contactarle a través de diferentes medios y la remisión de sus comunicaciones a los responsables correspondientes para que puedan darle respuesta.
C. Gestión de la participación en procesos de selección. Si contacta con MEDSIR a través de alguno de los formularios habilitados para los procesos de selección, MEDSIR utilizará sus datos de contacto y detalles que nos facilite para gestión de su participación en el proceso de selección concreto que ha motivado el envío de su currículum, así como, en su caso, para la gestión de su participación en los procesos de selección futuros de MEDSIR que se ajusten a su perfil profesional, si así lo ha consentido.
D. Gestión de donaciones. Gestión de las donaciones realizadas por el Usuario en relación con los estudios clínicos al efecto habilitados a través de la Web.
E. Navegación por el Sitio Web. Mediante el uso de cookies y otras tecnologías, MEDSIR podrá realizar mediciones y analizar el tráfico de navegación, la usabilidad y experiencia de los Usuarios en la Web de forma estadística. La instalación y uso de las cookies depende de la configuración que realice tanto en el banner de cookies como a través de su navegador.
3.2. Legitimación del tratamiento
MEDSIR podrá realizar los tratamientos para las finalidades anteriormente descritas en virtud de las siguientes bases de legitimación:
a) Para el envío de comunicaciones comerciales o noticias e información de interés cuando se suscriba al boletín de noticias: el consentimiento del interesado.
b) Para el contacto con MEDSIR: el consentimiento que preste a través del registro en los correspondientes formularios o, en algunos casos, la ejecución de medidas precontractuales si estas son necesarias para atender la consulta.
c) Para la gestión de su participación de procesos de selección: la ejecución de medidas precontractuales necesarias, en su caso, para poder tramitar su ulterior contratación en MEDSIR. La conservación de sus datos para su participación en procesos de selección futuros de MEDSIR que se ajusten a su perfil profesional se ampara en el consentimiento prestado, en su caso, al presentarse a un proceso de selección.
d) Para la gestión de la donación realizada por el Usuario en relación con estudios clínicos: el consentimiento inequívoco del interesado.
e) En relación con la navegación por la Web: el consentimiento que presta cuando acepta la instalación de las cookies y que puede revocar o configurar en cualquier momento a través del panel de configuración. Puede encontrar más información sobre el uso de las cookies en la Política de Cookies.
f) Para la gestión del registro y la asistencia a un evento: el consentimiento del interesado.
g) Para el uso de la imagen: el consentimiento del interesado.
En caso de que MEDSIR trate sus datos personales para una finalidad distinta a la establecida en este documento, MEDSIR le informará antes del procesamiento, le proporcionará cualquier información adicional relevante de acuerdo con la ley aplicable y solicitará su consentimiento si es necesario para justificar el tratamiento.
Recuerde que puede revocar su consentimiento en cualquier momento. También podrá oponerse a seguir recibiendo comunicaciones comerciales de la forma que se indica en el pie de página de cada comunicación.
3.3 Plazo de conservación de sus datos personales
Sus datos personales serán conservados, en función de la finalidad para la que hayan sido facilitados, durante los plazos que se indican a continuación:
a) El envío de boletines de noticias o comunicaciones comerciales: hasta que el Usuario registrado manifieste expresamente su voluntad de dejar de formar parte de la base de datos de MEDSIR, o hasta un máximo de dos años.
b) Contacto con los Usuarios en respuesta a una solicitud: durante el tiempo estrictamente necesario para atender su solicitud.
c) Gestión de su currículum en la participación en los procesos de selección:
i. Mientras dure el proceso de selección al que se ha presentado si finalmente no resulta seleccionado. En caso de ser seleccionado y aceptar la oferta de trabajo, el plazo de conservación de sus datos será el aplicable a los empleados de MEDSIR.
ii. Si ha dado su consentimiento para el tratamiento de sus datos con la finalidad de gestionar su participación en futuros procesos de selección de MEDSIR que se ajusten a su perfil profesional: por un plazo máximo de dos años desde la fecha en que los haya facilitado si no ha sido seleccionado en ningún proceso, por considerar que transcurrido este plazo la información de su currículum quedará desactualizada. En caso de ser seleccionado y aceptar la oferta de trabajo, el plazo de conservación de sus datos será el aplicable a los empleados de MEDSIR.
d) Gestión de la donación realizada por el Usuario en relación con estudios clínicos: durante el periodo estrictamente necesario para gestionar el estudio y poder acreditar el origen de los fondos recaudados.
e) Datos de navegación web: hasta que revoque su consentimiento y cómo máximo durante el plazo de un año. En todo caso, la información sobre el tráfico web se borra periódicamente, de modo que MEDSIR conservará únicamente datos estadísticos.
f) Eventos: durante un período directamente necesario para gestionar y celebrar el evento.
g) Imagen: durante el período estrictamente necesario para gestionar y celebrar el evento.
Fuera de los plazos indicados anteriormente, conservaremos sus datos personales durante el plazo de prescripción para cumplir o ejercer nuestras obligaciones o derechos legales (por ejemplo, para presentar o defender una reclamación). Asimismo, será de aplicación lo dispuesto en las normas corporativas relativas a los plazos de archivo y conservación de la documentación.
4. DESTINATARIOS DE LOS DATOS PERSONALES: CESIONARIOS Y ENCARGADOS DEL TRATAMIENTO
En determinados casos, podemos dar acceso a sus datos personales a terceros (encargados del tratamiento) que nos prestan servicios tales como agencias de comunicación, marketing, medios digitales y redes sociales, que nos ayudan a llevar a cabo nuestros servicios de manera eficiente y dentro del marco legal. Asimismo, podemos ceder los datos a empresas de nuestro grupo con fines de gestiones internas, como, por ejemplo, la gestión de procesos de selección.
El tratamiento de datos personales por parte de estos encargados del tratamiento, con los que se ha celebrado un contrato en virtud del artículo 28 del RGPD, puede realizarse tanto dentro como fuera del territorio de la Unión Europea. Si se realizaran transferencias de datos fuera del Espacio Económico Europeo, estas se harían (i) a países con un adecuado nivel de protección declarado por la Comisión Europea (ii) en base a la aportación de garantías adecuadas (cláusulas contractuales tipo o normas corporativas vinculantes), o (iii) en virtud de la autorización de la autoridad de control competente u otros supuestos previstos en la normativa.

Fuera de los supuestos anteriores, sus datos personales no serán comunicados a terceros, salvo obligación legal.
5. ALTA Y SEGUIMIENTO DE CUENTAS CORPORATIVAS DE REDES SOCIALES WEB
En el caso de los perfiles que MEDSIR mantiene en las distintas redes sociales enlazadas desde la Web, por ejemplo, a través de plug-ins o aplicaciones de terceros, sus datos podrán tratarse bajo otras políticas de privacidad de los titulares de dichas redes sociales.
El uso de dichos conectores es voluntario. En caso de optar por utilizarlos, estará autorizando la comunicación de sus datos personales (dirección IP, datos de navegación) a las referidas redes sociales y MEDSIR no será responsable del ulterior tratamiento que las mismas puedan realizar con sus datos. Le recomendamos que visite los términos y condiciones de uso de dichas plataformas con carácter previo a su interacción en redes sociales con los perfiles de MEDSIR en dichas redes sociales.
Los perfiles en las redes sociales enlazadas desde esta Web han sido creados para que conozca mejor la actividad de MEDSIR y ofrecer distintos canales de comunicación dirigidos a las personas interesadas en nuestra entidad y los servicios que se ofrecen.
6. DERECHOS DE LOS INTERESADOS
Tiene derecho a obtener confirmación sobre si MEDSIR está tratando sus datos personales. También tiene derecho a acceder a sus datos personales, así como a solicitar la rectificación de los datos inexactos o, en su caso, solicitar su supresión cuando, entre otros motivos, dichos datos ya no sean necesarios para los fines que por los que fueron recogidos.
En determinadas circunstancias, podrá: (i) solicitar la restricción del tratamiento de sus datos personales, en cuyo caso únicamente los conservaremos para el ejercicio o la defensa de reclamaciones; (ii) por motivos relacionados con su situación particular, podrá oponerse al tratamiento de sus datos personales, en cuyo caso MEDSIR dejará de tratarlos salvo por motivos legítimos imperiosos, o para el ejercicio o la defensa de posibles reclamaciones; y, si ha otorgado su consentimiento para una finalidad determinada, (iii) su consentimiento podrá ser retirado en cualquier momento, sin que ello afecte a la legitimidad del tratamiento basado en el consentimiento previo a su retirada.
También tiene derecho a recibir, en un formato estructurado, de uso común y legible por máquina, los datos personales que le conciernen y que ha proporcionado a MEDSIR, y a transmitir esos datos a otro responsable del tratamiento sin impedimentos por parte de MEDSIR. En este sentido, puede solicitar a MEDSIR que transmita sus datos personales directamente, si es técnicamente factible, al nuevo responsable indicado en su comunicación.
Podrá ejercer sus derechos mediante el envío de una solicitud firmada digitalmente (DNI electrónico u otro certificado reconocido) a MEDSIR a través del correo electrónico dpo@medsir.org, o mediante comunicación escrita dirigida a Medica Scientia Innovation Research, S. L., con domicilio a estos efectos en Calle Pere IV, Planta 3ª, 08005 Barcelona (España), con asunto o referencia “RGPD”.
El contenido de la solicitud debe incluir: su nombre y apellidos; fotocopia de su documento nacional de identidad, pasaporte u otro documento válido que le identifique y, de ser necesario, de la persona que le represente, así como del documento o instrumento electrónico que acredite tal representación; detalle de la solicitud realizada, domicilio para notificaciones, fecha y firma del solicitante; y documentos justificativos de la solicitud que realice, en su caso. "CLINICAL TRIAL IDEAS" CONTEST POLICY
Legal Terms and Conditions of the “Oncology Clinical Trial Ideas Contest” by MEDSIR
1. Purpose
1.1. These terms and conditions govern the Oncology Clinical Trial Ideas Contest (the “Contest”), organized by MEDICA SCIENTIA INNOVATION RESEARCH, S.L. (hereinafter, “MEDSIR”), with the purpose of identifying innovative oncology clinical trial ideas that may be suitable for potential collaborative development.
1.2. Participation in the Contest is free of charge and does not require participants to make any payment or purchase any product or service from MEDSIR.
1.3. The prize will consist of a grant to cover travel, accommodation and, where applicable, registration costs for attendance at MEDSIR Clinical Trial Ideas Contest, under the terms set out in clause 8.
2. Organizing entity
The organizing entity is MEDICA SCIENTIA INNOVATION RESEARCH, S.L. (“MEDSIR”), with registered office at Pere IV 128, 3rd floor and tax identification number B65778946, and contact email info@medsir.org .
3. Territorial scope and duration
3.1. The Contest will have a European economic area, United Kingdom and Ireland scope, without prejudice to any restrictions arising from national law or codes of conduct applicable to certain professional profiles, including healthcare professionals.
3.2. The submission period will begin on 23/06/2026 and end on 20/08/2026. Proposals received after the deadline will not be accepted.
4. Eligibility requirements
4.1. Individuals over 18 years of age with a professional or academic connection to clinical research, oncology, biomedicine or related fields (including investigators, physicians, research staff and statisticians) may participate, provided they comply with these terms and conditions.
4.2. Participation may be subject to prior authorization from, or notification to, the participant’s employer or affiliated institution where required under internal rules on conflict of interest, transparency or professional compatibility.
4.3. Employees of MEDSIR, members of the judging panel, and any persons directly involved in organizing the Contest, as well as their immediate family members up to the second degree, may not participate.
4.4. MEDSIR reserves the right to exclude any participant who does not meet the eligibility requirements or who breaches these terms and conditions.
5. Contest mechanics
5.1. Participation shall be made exclusively through the form available on the website www.medsir.org. Participants must complete all mandatory fields and submit the required information regarding their clinical trial idea.
5.2. Proposals must be submitted in the form of a high-level idea or synopsis and should, for guidance purposes, include:
• Therapeutic area and oncology indication.
• Main objective of the trial.
• Target population and general inclusion/exclusion criteria.
• Overall study design (for example, phase, comparator and primary endpoints).
• Brief scientific rationale.
5.3. Each participant may submit proposals, each of which must be original and independent.
5.4. Participants shall be solely responsible for the content of their proposals. It is expressly prohibited to include personal data relating to patients or other third parties, as well as information subject to confidentiality obligations owed to third parties, including sponsors, institutions or companies.
5.5. Submission of a proposal does not create any entitlement for the participant to have the clinical trial developed by MEDSIR or to enter into any further agreement with MEDSIR.
6. Nature of the information and confidentiality
6.1. Information submitted by participants shall be deemed non-confidential for the purposes of the Contest. Participants should not include any information they consider secret or confidential.
6.2. If MEDSIR is interested in further exploring the development of a particular proposal, the parties may negotiate and execute a separate agreement (for example, a confidentiality agreement, collaboration agreement, or assignment/license agreement), which will govern the level of detail of any additional information to be shared and the intellectual and industrial property regime applicable to subsequent stages.
7. Evaluation criteria and judging panel
7.1. Proposals will be assessed by a judging panel appointed by MEDSIR and composed of professionals with experience in clinical research, oncology, trial design and/or regulatory matters.
7.2. Evaluation criteria will include, among others:
• Scientific quality and robustness of the idea.
• Originality and innovation.
• Clinical and regulatory feasibility.
• Potential impact on patients and clinical practice.
• Alignment with MEDSIR’s areas of interest.
7.3. The judging panel will select the winning proposal. The panel’s decision shall be final and binding, and the Contest may be declared void if the proposals do not meet a minimum quality threshold.
7.4. MEDSIR will notify the winner directly using the email address provided by the participant and may subsequently publish the winner’s name, surname, affiliation and proposal title on its website and corporate channels, in accordance with clause 11.
8. Prize: travel grant
8.1. The prize will consist of a grant covering, within the limits specified below:
• Round-trip transportation from the winner’s country of residence to the Event venue.
• Hotel accommodation in a 4-star hotel for 1 night.
• Event registration fee, where applicable.
8.2. The grant will have a maximum total value of EUR 500. Any expenses not expressly included, such as meals, supplementary insurance, visas or personal expenses, shall be borne by the winner.
8.3. The prize is personal and non-transferable unless MEDSIR expressly authorizes otherwise in writing.
8.4. 8.5. The prize may be subject to tax obligations for the winner under applicable law. The winner shall be responsible for such obligations, without prejudice to any withholding or reporting obligations that may apply to MEDSIR.
9. Participation of healthcare professionals
9.1. MEDSIR organizes, funds and promotes the Contest and the related travel grant using its own resources. MEDSIR is not a member of any pharmaceutical or medical device industry association and is not formally bound by any related code of conduct.
9.2. Participation in the Contest and, where applicable, acceptance of the prize shall be subject to compliance with the applicable laws, including those regulating transparency of transfers of value to Healthcare Professionals.
9.3. The Healthcare Professional represents and warrants that:
• It is the sole responsibility of the Healthcare Professional to comply with any rules applicable to transparency, conflicts of interest, or receipt of grants or in-kind benefits of their employer.
• They have reviewed and comply with said rules.
• Submission of the proposal and, where applicable, acceptance of the prize do not breach such rules or applicable law.
• They will inform their institution, ethics committee or competent authority, where required, of their participation in the Contest and, where applicable, of the award of the prize.
9.4. Regardless of the above, MEDSIR may, where necessary to ensure compliance with applicable transparency laws:
• notify the Healthcare Professional’s institution of the award of the prize and/or request evidence of any required internal approvals or notifications.
• Publish and/or disclose information relating to it, including the Healthcare Professional’s name, institution and the nature of the benefit, where required by applicable law.
9.5. MEDSIR may exclude a participant from the Contest or revoke the prize if it becomes aware that the Healthcare Professional has failed to comply with the internal rules of their institution, applicable law or transparency and healthcare professional interaction rules, or refuses to provide information reasonably required to verify such compliance.
Before definitively revoking or withholding the prize, MEDSIR may request that the Healthcare Professional, within a reasonable period, provide documentation or information necessary to evidence compliance.
9.6. MEDSIR may withhold the prize if granting it to the winner entails a breach of the law.
9.7. Participation by Healthcare Professionals in the Contest does not imply that the content of the proposals has been reviewed, approved or endorsed by health authorities, scientific societies, ethics committees or similar bodies. Any subsequent development of a clinical trial derived from the proposals shall remain subject to the ethical and regulatory approvals required by law.
10. Intellectual and industrial property
10.1. Participation in the Contest does not entail the automatic transfer to MEDSIR of any intellectual or industrial property rights that may subsist in the participant’s proposal. The participant shall retain ownership of the idea, without prejudice to the licenses set out below.
10.2. The participant represents and warrants that:
• They own the rights in the proposal or have obtained all necessary authorizations to submit it to the Contest.
• The proposal is original and does not infringe any intellectual property rights, industrial property rights, trade secrets or any other rights of third parties.
• The proposal does not breach any confidentiality obligations owed to third parties.
10.3. By participating in the Contest, the participant grants MEDSIR a non-exclusive, worldwide, royalty-free and temporary license, for a period of 2 years from the close of the Contest, to use the information contained in the proposal solely for the purpose of:
• Assessing its scientific, technical and regulatory viability.
• Analyzing its potential fit within MEDSIR’s research lines and areas of interest.
• Holding discussions, where appropriate, with the participant and/or their institution regarding possible collaboration or joint development.
10.4. Any subsequent development of the clinical trial or of projects related to the winning or finalist proposals shall be governed by the specific agreements that may be entered into by MEDSIR, the participant and/or the participant’s affiliated institution, including co-development agreements, study sponsorship agreements, and assignment or license agreements.
10.5. Participation in the Contest does not grant participants any rights in MEDSIR’s trademarks, trade names, distinctive signs or website content.
11. Contest publicity and use of name and image
11.1. MEDSIR may promote the Contest and its results through its website, social media channels, newsletters and other corporate communication channels.
11.2. If selected as winner, the participant authorizes MEDSIR, on a worldwide basis, without additional compensation and for the maximum period permitted under applicable law, to reproduce and communicate publicly their name, surname, institutional affiliation, country and the title of the proposal for information and promotional purposes relating to the Contest and future editions, in accordance with the Contest Privacy Policy.
11.3. Where the winner is a Healthcare Professional, the use of their name, affiliation and, where applicable, image in public communications relating to the Contest shall be carried out in compliance with applicable transparency requirements and the restrictions established by the applicable codes of conduct and the policies of the winner’s institution. MEDSIR may adapt the manner in which such information is published to ensure compliance.
11.4. Where required by applicable data protection law, MEDSIR will obtain the winner’s specific consent for the use of their image, for example in photographs or videos taken during the Event, for corporate communication purposes.
12. Limitation of liability
12.1. MEDSIR shall not be liable for entries that are not received, are incomplete, illegible, defective or cannot be processed due to technical issues of any kind, including software, hardware or communications failures.
12.2. MEDSIR shall not be liable for any improper, negligent or unlawful use that participants may make of their proposals or for any infringement of third-party rights arising therefrom. Participants shall remain solely liable in relation to any such claims.
12.3. If the Event is cancelled, modified or postponed by its organizers, or due to force majeure, MEDSIR shall not be liable to the winner, although it will seek to offer a reasonable alternative, such as attendance at another event of similar characteristics or rescheduling of the trip, without any entitlement to additional compensation.
13. Amendment and cancellation of the Contest
13.1. MEDSIR reserves the right to amend these terms and conditions at any time, provided that the essence of the Contest is not altered and participants are not unfairly prejudiced. Any amendment will be duly communicated through www.medsir.org and, where appropriate, by email to registered participants.
13.2. MEDSIR may also cancel or suspend the Contest in the event of force majeure, fraud, manipulation, non-payment of the Event by third parties, or any circumstance preventing its proper implementation, without participants being entitled to compensation.
14. Acceptance of the terms and conditions
14.1. Participation in the Contest implies full and unconditional acceptance of these terms and conditions and of the Contest Privacy Policy.
14.2. Any refusal to accept all or part of these terms and conditions shall result in the immediate exclusion of the participant, and MEDSIR shall be released from any obligation owed to such participant.
15. Governing law and jurisdiction
15.1. These terms and conditions shall be governed by Spanish law.
15.2. Unless mandatory law provides otherwise, the parties submit, with express waiver of any other jurisdiction that may otherwise apply, to the courts of Barcelona for the resolution of any dispute arising out of or in connection with the Contest.
Privacy Policy for the “Oncology Clinical Trial Ideas Contest” by MEDSIR
1. Data controller
The controller of participants’ personal data is MEDICA SCIENTIA INNOVATION RESEARCH, S.L. (hereinafter, “MEDSIR”), with registered office at Pere IV 128, 3rd floor and tax identification number B65778946, and contact email dpo@medsir.org.
2. Purposes of the processing
2.1. Personal data will be processed for the following main purposes:
• Managing participation in the Oncology Clinical Trial Ideas Contest, including receipt and evaluation of proposals, communications with participants, and management of the award and use of the prize where applicable.
• Complying with legal obligations applicable to MEDSIR, including tax and accounting obligations arising from the award of the prize and, where applicable, transparency obligations in relation to healthcare professionals.
• Assessing, at a later stage, the possibility of exploring collaborations in projects for clinical studies.
2.2. Additionally, and only where the participant gives consent by ticking the relevant box, personal data may be processed in order to:
• Send informational and marketing communications relating to scientific activities, clinical trials, publications, events and services of MEDSIR.
• Publish, for information and Contest dissemination purposes, the winner’s name and surname, institutional affiliation, country and proposal title on MEDSIR’s website, social media and other corporate channels, and use the winner’s image in photographs or videos taken in connection with the Event, in accordance with the Contest terms and conditions.
3. Categories and source of personal data
3.1. The categories of personal data processed will generally be those provided by the participant through the website form or in subsequent communications, including:
• Identification data: name and surname.
• Professional data: institutional affiliation, title/role, country, specialty or area of work.
• Contact details: professional email address and, where applicable, contact telephone number.
• Information relating to the submitted proposal: title, summary and high-level content of the clinical trial idea, excluding patient personal data and confidential third-party information.
3.2. Participants undertake that all personal data provided are truthful, accurate, complete and kept up to date.
3.3. Participants must not include personal data of patients or other third parties in their proposals. If such data are identified, MEDSIR may delete them and/or exclude the proposal from the Contest.
4. Legal basis for processing
4.1. The legal bases for processing personal data are as follows:
• Performance of the legal relationship arising from participation in the Contest, pursuant to Article 6(1)(b) GDPR, for the purposes described in section 2.1.
• Compliance with legal obligations applicable to MEDSIR, pursuant to Article 6(1)(c) GDPR, in particular tax, accounting and, where applicable, transparency obligations vis-à-vis healthcare professionals and their institutions.
• MEDSIR’s legitimate interests, pursuant to Article 6(1)(f) GDPR, in assessing, after the Contest, the possibility of exploring collaborations with the participants of the Contest in potential projects for clinical studies, based on their professional profile and the high-level information contained in their proposals.
• The participant’s consent, pursuant to Article 6(1)(a) GDPR, for the additional purposes described in section 2.2, namely marketing communications and use of identification data and, where applicable, image for dissemination purposes.
4.2. Participants withdrawing their consent would only prevent MEDSIR from processing personal data based on consent and only after withdrawal.
5. Data retention period
5.1. Personal data will be retained for as long as necessary to manage the Contest, assess proposals, communicate the outcome and, where applicable, manage the award and use of the prize, as well as for the periods required to address any claims related to the Contest.
5.2. Once those periods have elapsed, the data will remain duly blocked for the applicable statutory limitation periods relating to civil, commercial, tax and data protection liabilities, after which they will be deleted or anonymized.
5.3. Where MEDSIR relies on its legitimate interests to assess the possibility of exploring collaborations in potential projects for clinical studies with the Contest participants, professional contact details and high level information about the proposals will not be retained for longer than justified by the opening of specific discussions with a participant or by the execution of a separate agreement (for example, a confidentiality agreement), in which case the retention periods provided for in such agreement will apply.
5.4. Where the participant has consented to receive informational and marketing communications, their data will be retained until such consent is withdrawn.
6. Recipients and international transfers
6.1. As a general rule, personal data will not be disclosed to third parties except:
• To public administrations, authorities, professional bodies and courts where required by applicable law or necessary to respond to claims or official requests.
• To service providers strictly necessary for prize management, such as travel agencies, hotels or Event organizers, to the extent they need access to the participant’s data for booking transportation, accommodation or registration.
6.2. Where participants are Healthcare Professionals, certain data relating to the award of the prize may be disclosed to their institution, sector associations or entities responsible for transparency registers where required by applicable law or by sectoral codes that are binding on the recipient or its institution. Where MEDSIR is not directly subject to a legal obligation to make a named disclosure and transparency requirements arise primarily from internal rules or codes applicable to the participant or their institution, MEDSIR will, as required by the participant or their institution, channel the information through the institution so that it can comply with its own transparency obligations.
6.3. Some of the above recipients may be located outside the European Economic Area. In such cases, MEDSIR will implement appropriate safeguards in accordance with Articles 44 et seq. GDPR, including, where appropriate, the European Commission’s standard contractual clauses.
7. Security measures
7.1. MEDSIR will implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including access controls, secure connections and safeguards against unauthorized access, loss, destruction or alteration of information.
7.2. Access to participants’ data will be limited to personnel and collaborators who need to know such data for the purposes described in this policy and who are subject to confidentiality obligations.
8. Rights of participants
8.1. Participants may exercise at any time, in accordance with applicable law, the following rights:
• Right of access.
• Right to rectification.
• Right to erasure.
• Right to object.
• Right to restriction of processing.
• Right to data portability.
8.2. In addition, where the legal basis for processing is consent, participants have the right to withdraw such consent at any time. Where the legal basis for processing is MEDSIR’s legitimate interests, participants have the right to object at any time, in which case MEDSIR would only keep processing their personal data if overriding legitimate interests or other legal basis concur.
8.3. Rights may be exercised by sending a written communication dpo@medsir.org or to the postal address indicated in section 1, stating “Contest Participation – Data Protection” and providing proof of identity.
8.4. If a participant considers that the processing of their personal data infringes applicable law, they may lodge a complaint with the competent supervisory authority. In Spain, the competent supervisory authority is the Spanish Data Protection Agency (www.aepd.es).
9. Mandatory nature of the data
9.1. Data marked as mandatory in the participation forms are necessary in order to manage participation in the Contest.
9.2. Failure to provide such data, or providing incomplete or inaccurate data, may prevent participation from being processed or, where applicable, the prize from being managed.
10. Updates to the Privacy Policy
10.1. MEDSIR may update this Privacy Policy where necessary to adapt it to changes in law, case law, industry practice or the legitimate interests of the company.
10.2. The current version will be available at all times on the Contest website, together with the date of the latest update.
